Acceptance of Terms and Conditions of Use
These Terms and Conditions of Use for My TutorCloud constitute a legal agreement entered into by and between you (“User”, “You” or “Your”) and My TutorCloud (“Company”, “We”, “Us” or “Our”). The following terms and conditions, together with any documents and/or additional terms they expressly incorporate by reference (collectively, these “Terms and Conditions”), govern your access to and use of the Services, including any content, functionality, and services offered on or through the website (mytutorcloud.com) and mobile app (collectively, the “Sites”).
BY USING MY TUTORCLOUD OR BY CLICKING TO ACCEPT THESE TERMS AND CONDITIONS, YOU ACCEPT AND AGREE TO BE BOUND BY AND COMPLY WITH THESE TERMS AND CONDITIONS AND OUR PRIVACY POLICY (FOUND AT terms and condition ), WHICH IS INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS OR THE PRIVACY POLICY, YOU MUST NOT ACCESS OR USE MY TUTORCLOUD.
By using My TutorCloud, you represent and warrant that you are of legal age of majority under applicable law to form a binding contract with the Company and that you meet all eligibility requirements. If you do not meet these requirements, you must not access or use My TutorCloud.
Key Terms
- “User”, “you”or “your” means a person, organization or entity using the Services, including Parents and Teachers.
- “Parent(s)”means a parent or legal guardian who completes My TutorCloud’s account registration process to purchase Classes for the purpose of enrolling their child.
- “Teacher(s)”means a person who completes My TutorCloud’s account registration process, or an organization that executes an agreement with My TutorCloud to provide Classes on the Site.
- “Class(es)”means any online class(es) submitted by a Teacher on the Site.
Modifications to the Terms and Conditions
We reserve the right, in our sole discretion, to revise and update these Terms and Conditions from time to time. Any modifications are effective immediately upon posting and apply to all access to and continued use of My TutorCloud. You agree to periodically review these Terms and Conditions to stay informed of any updates. Your continued use of the Sites constitutes your acceptance of the revised terms.
We may change, withdraw, or terminate any information, material, or service on My TutorCloud at any time in our sole discretion without notice. We will not be liable if, for any reason, all or any part of the Sites becomes unavailable at any time or for any period.
Your Use and Account Set-Up and Security
My TutorCloud is an EdTech platform dedicated to providing high-quality online educational services through innovative video conferencing tools. Our platform uses advanced technology to deliver personalized learning experiences.
Account Security: You are responsible for maintaining the confidentiality of your username, password, and any other security information. You must treat such information as confidential and not disclose it to any third party. You agree to notify us immediately of any unauthorized access to or use of your account. You are fully responsible for all activities that occur under your account.
We reserve the right to disable or terminate your account at any time for any reason, including violation of these Terms and Conditions.
Recordings: Classes conducted through My TutorCloud are automatically recorded. Recordings are made available primarily to the Teacher for the purposes of:
- Providing a copy to Learners who missed the class or wish to review it.
- Allowing the Teacher to improve their lessons.
In cases where the Teacher is an organization or team, the organization may have access to the recordings. My TutorCloud may also use recordings internally for quality assurance, teacher feedback, customer support, and compliance purposes.
We will not use recordings containing your or your child’s image for promotional purposes without your prior written consent. By using the Services, you consent to recordings for the limited educational and service-related purposes described above.
You are strictly prohibited from attempting to circumvent the security of the Sites, introducing viruses or harmful code, launching denial-of-service attacks, or engaging in any other disruptive or unauthorized activity.
Certain Teacher Obligations
Community Standards: Teachers must maintain professional conduct, communicate respectfully, and serve as positive role models. Inappropriate behavior, hate speech, harassment, or any actions detrimental to the platform may result in immediate removal.
Learner Safety: Teachers must immediately report any suspected child abuse or neglect to My TutorCloud. My TutorCloud may report such cases to appropriate authorities as required or deemed necessary.
Intellectual Property Rights and Ownership
All content, features, and functionality on My TutorCloud — including software, text, graphics, images, videos, audio, design, and layout — are owned by the Company, its licensors, or other providers and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.
You may use My TutorCloud only for your personal, non-commercial educational purposes as permitted. You are not allowed to reproduce, distribute, modify, create derivative works of, publicly display, or transmit any material from the Sites without prior written permission from the Company.
Any unauthorized use terminates the rights granted herein and may violate intellectual property laws.
Conditions of Use and User Submissions and Site Content Standards
You agree to use My TutorCloud only for lawful purposes and in accordance with these Terms and Conditions.
You warrant that your User Submissions will not:
- Violate any applicable laws or regulations.
- Contain obscene, abusive, harassing, defamatory, discriminatory, or harmful content.
- Infringe intellectual property or privacy rights of others.
- Impersonate any person or entity.
- Contain spam, advertisements, or unauthorized promotions.
- Promote illegal activities.
User Submissions License: By submitting any content, you grant My TutorCloud a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, display, and distribute such content for the purposes of operating and improving the Services.
You remain fully responsible for your User Submissions and agree to indemnify the Company against any claims arising from them.
Site Monitoring and Enforcement
We reserve the right to remove, refuse to post, or disable access to any User Submissions for any reason. We may suspend or terminate your access to the Sites without notice for violations of these Terms.
We cooperate fully with law enforcement authorities when required.
No Reliance
Content on My TutorCloud is provided for general information only. We do not warrant that the content is accurate, complete, or up-to-date. Your use of the Sites is at your own risk.
Privacy
Your use of My TutorCloud is also governed by our Terms and Conditions. By using the platform, you consent to the collection and use of your information as described therein.
Third-Party Websites
Links to third-party websites are provided for convenience only. We have no control over and assume no responsibility for their content or practices.
Geographic Restrictions
My TutorCloud is intended for users in jurisdictions where its use is permitted. If you access the Sites from outside Canada, you do so at your own risk and are responsible for compliance with local laws.
Disclaimer of Warranties
MY TUTORCLOUD AND ITS SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
Limitation on Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MY TUTORCLOUD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITES OR SERVICES.
Indemnification
You agree to indemnify and hold harmless My TutorCloud, its affiliates, directors, officers, employees, and agents from any claims, damages, losses, and expenses (including legal fees) arising from your breach of these Terms or your use of the Services.
Governing Law and Choice of Forum
These Terms and Conditions shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved exclusively in the courts of Ontario.
Severability, Waiver, and Entire Agreement
If any provision is held invalid, the remaining provisions remain in full force. Failure to enforce any right does not constitute a waiver. These Terms, together with the Privacy Policy, constitute the entire agreement between you and My TutorCloud.
